In The Theory of Moral Sentiments (TMS) Adam Smith draws on the Stoic idea of a Providence that uses everything for the good of the whole. The process is often painful, so the Stoic ethic insisted on conscious cooperation. Stoic ideas contributed to the rise of science and enjoyed wide popularity in Smith's England. Smith was more influenced by the Stoicism of his professors than by the Epicureanism of Hume. In TMS, Marcus Aurelius's "helmsman" becomes the "impartial spectator," who (...) judges actions in terms of the way they are seen by others. This is the key to justice, without which society collapses. Business school students should be taught that Smith's "invisible hand" is best understood as a universal rationality that uses just actions for the benefit of the whole. (shrink)

The theory of mind (ToM) deficit associated with autism spectrum disorder has been a central topic in the debate about the modularity of the mind. In a series of papers, Philip Gerrans and Valerie Stone argue that positing a ToM module does not best explain the deficits exhibited by individuals with autism (Gerrans 2002; Stone & Gerrans 2006a, 2006b; Gerrans & Stone 2008). In this paper, I first criticize Gerrans and Stone’s (2008) account. The Alcibiades purports to offer us the very first conversation between Socrates and Alcibiades. Previously, it seems, Socrates has just lingered at the back of a crowd of lovers looking rather stupid. This is hardly surprising. Socrates did look stupid, and both Aristophanes and his rival Ameipsias thought that he was good enough material for a laugh to present him on stage in their comedies at the Dionysia of 423 BC. The only slight surprise here is that Alcibiades, though he (...) is mentioned in other Aristophanic comedies, is never actually named in the Clouds. One might suspect that the young man Pheidippides, whom Socrates exposes to the corrupting influence of philosophic argument and the ensuing amoral attitudes, bears some relationship to Alcibiades. He shares with him a partially Alcmaeonid background, a passion for horse-racing, and an interesting lisp, but as the play stands Pheidippides is never seen as having been in any way close to Socrates.1 Their relationship is in fact akin to one between the principal of a college and an individual first-year student, with no sinister overtones whatever. I doubt that the relationship with Alcibiades had by that stage been seen as in any way unusual; either its bizarre nature was a well-kept secret, or it was not seen as very unusual after all. Alcibiades had experienced the attentions of a host of would-be lovers, so what would have made Socrates special? (shrink)

Organ tourism occurs when individuals in countries with existing organ transplant procedures, such as the United States, are unable to procure an organ by using those transplant procedures in enough time to save their life. In this paper, I am concerned with the following question: When organ tourists return to the United States and need another transplant, do US transplant physicians have an obligation to place them on a transplant list? I argue that transplant physicians have a duty not to (...) relist organ tourists. Specifically, I contend that we should locate physicians’ duties in these cases within the new role of “transplant physician.” This role results from transplant physicians’ participation in a system that depends on organ donors’ voluntary act of donation. The book approaches law from the legal-linguistic perspective. Its aim is to clarify the processes in which the meaning of law emerges in legal discourses. In order to enable the understanding of law as a discursive practice, professional and non-professional discourses are analyzed. With this aim in mind, the author focuses on the epistemological consequences of the discursiveness of law. Other relevant legal-linguistic operations such as legal interpretation or legal translation are scrutinized in terms of their theoretical prerequisites and their (...) practical consequences. Their analysis also shows the potential and the limits of law as a social and as a linguistic phenomenon that is determined by its discursiveness. Finally, the book demonstrates how the discursiveness as the distinctive feature of law establishes the connection between the science of law and other social sciences. (shrink)

Abstract The current accountability system for private military and security contractors (PMSCs) is woefully inadequate, and mere enhancements in oversight cannot hope to remedy that failing. I contend that once we recognize the kind of accountability required of PMSCs, we will realize that radical changes in the foundational relationship between PMSCs and the state are required. More specifically, in order to be appropriately accountable, members of PMSCs must become a part of or, at the very least, directly responsible to the (...) legitimate authoritative military or police structures, and there must be a clear and precise delineation of responsibility among public officials for holding individual members of PMSCs criminally liable. Mercy is the defining characteristic of Pope Francis’s leadership. Francis’s words and actions have made visible a discipline of mercy, which does more than illuminate God’s character and purpose; it offers an expansive imaginative framework to spark new possibilities for moral agency and growth. Before Francis, mercy received limited attention in the canon of Catholic social thought. Francis’s signature message of mercy retrieves a central moral duty in Scripture, provides a focal lens for Catholic social thought, and aims to inspire (...) a “revolution of tenderness” capable of inspiring personal conversion and social change. This essay moves forward in three steps. It first unpacks the rich and diverse meaning of the word mercy and explores its undervalued role in CST; it then analyzes how mercy functions as the crux of Francis’s moral imagination; and finally, it explores how mercy expands possibilities for living the principles of Catholic social thought. Previous research into human traits has reached impressive consensus regarding at least some traits, but recent evidence suggests these to be genetically heterogeneous. This is problematic for theories of the neurobiology of human traits. Future research should more closely integrate genetic, behavioral, and psychometric research to arrive at biologically validated measurement instruments, which may be better used to understand the mediating role of these traits in the association between genetic variants and complex behaviors.

This article examines the idea of disjunctive rights—an idea first suggested by Joel Feinberg and more recently advocated by Richard Arneson. Using a hypothetical scenario to bring forward a conflict between two rights that cannot be simultaneously fulfilled, the suggestion that the conflict can be solved by describing the right-holders as holding disjunctive rights—rights that involve, in a significant way, a disjunction—is scrutinized. Several interpretations of the idea of disjunctive rights are examined from the perspectives of the interest theory and (...) will theory of rights. Ultimately, the idea of disjunctive rights fails to provide an acceptable solution to the problem at hand, as each interpretation has unacceptable implications. This conclusion challenges the compossibilist thesis, according to which moral rights do not, ultimately, conflict. Alternatively, if one wishes to keep the possibility of compossibility and disjunctive rights, the mainstream theories of rights must be revised or rejected. (shrink)
